1. About these terms
These terms apply when you buy products from Nexcart ("we", "us", "our"), whether through our website at www.nexcart.co.uk or through one of our marketplace shops. Please read them before placing an order. By placing an order, you agree to these terms.

These terms are for consumers, meaning individuals buying for personal use. Nothing in them affects your legal rights as a consumer, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

2. Buying through a marketplace
We also sell on eBay, TikTok Shop, Facebook Marketplace and Instagram. If you buy one of our products on one of these platforms:
- the platform's own terms, including its buyer protection and payment rules, apply to your purchase alongside these terms;
- if these terms and the platform's rules conflict, the platform's rules take priority for that order; and
- you should usually start a return or raise a problem through the platform, so your purchase stays covered by its buyer protection.
We are the seller of the product, not the platform, so you can also contact us directly using the details in section 1.
3. Our products
We sell products made or supplied by independent small businesses that we partner with. We are the seller, so your contract is with us, and we are responsible for the products we sell you.
We try to show products accurately, but colours may look slightly different on your screen, and handmade or natural products may vary a little from the photos. Packaging may also differ from what is shown.
Some products carry age restrictions. We may ask for proof of age and cancel an order if we cannot confirm you are old enough to buy the product.
4. Placing an order
When you place an order, we will email you to confirm we have received it. This email does not mean we have accepted your order. Our contract with you starts when we email you to confirm that your order has been dispatched.
We may not be able to accept your order if, for example, the product is out of stock, we cannot deliver to your address, there is an obvious pricing error, or we suspect fraud. If this happens, we will tell you and refund any payment in full.
5. Prices and payment
All prices are in pounds sterling (£) and include VAT at the current rate. The price you pay is the price shown when you place your order. Any delivery charges, and any other fees you must pay, are shown before you confirm your order.
We take great care with our prices, but mistakes can happen. If a price is obviously wrong and you could reasonably have noticed the error, we do not have to supply the product at that price. We will contact you to ask whether you want to buy it at the correct price or cancel.
We accept payment through [Shopify Payments / PayPal / Apple Pay / Google Pay / other]. Payment is taken when you place your order. Marketplace orders are paid through the platform's own checkout.
Discount codes and promotions are subject to their own stated conditions, cannot be exchanged for cash, and cannot be used together unless we say so.
6. Delivery, returns and refunds
Our delivery terms are set out in our Shipping Policy, and our returns and refunds terms are set out in our Return and Refund Policy. Both form part of these terms.
7. Our responsibility to you
If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to take reasonable care. We are not responsible for loss or damage that was not foreseeable, or for business losses, as our products are for personal use only.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, for breach of your legal rights as a consumer, or for defective products under the Consumer Protection Act 1987.
We are not responsible for delays or failures caused by events outside our reasonable control. If this happens, we will contact you as soon as possible and you may cancel your order for a full refund.
8. Reviews and content
We welcome honest reviews. We never write fake reviews, pay for positive reviews without saying so, or hide genuine negative reviews. We may remove reviews that are offensive, unlawful, or not about the product.
All content on our website, including text, images and our logo, belongs to us or our partner businesses. You may not copy it for commercial use without our permission.
9. Your personal information
We use your personal information as set out in our Privacy Policy.
10. Complaints and disputes
If you have a problem, please contact our customer service team first at nexcart.co.uk@gmail.com. We aim to reply within 2 working days and to resolve complaints as quickly as possible.
If you bought through a marketplace, you can also use that platform's dispute or resolution process. If we cannot resolve a dispute, you may be able to use an alternative dispute resolution service, or you can take legal action.
11. Other important terms
- Changes to these terms. We may update these terms from time to time. The version that applies to your order is the one shown on our website when you placed it.
- Transfer. We may transfer our rights under these terms to another business. We will tell you if this affects your order, and it will not affect your legal rights.
- Severability. If a court finds part of these terms invalid, the rest will still apply.
- Delays in enforcing. If we do not insist straight away that you do something you are required to do, we can still require it later.
- Governing law. These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
